Ontario Cautiously Easing Capacity Limits in Select Settings Where Proof of Vaccination is Required
TORONTO- September 24

"Effective September 25, 2021, at 12:01 a.m., capacity limits will be increased in many of the indoor settings where proof of vaccination is required. Meeting and event spaces, such as banquet halls and conference/convention centres; sporting events; concerts, theatres and cinemas; racing venues (e.g., horse racing); and commercial and film television productions with studio audiences will be increased to up to 50 per cent capacity or 10,000 people (whichever is less) for indoor events.

For certain outdoor event venues where patrons stand, capacity limits will increase to up to 75 per cent capacity or 15,000 people (whichever is less). For certain outdoor event venues where patrons are seated, capacity limits will be increased to up to 75 per cent capacity or 30,000 people (whichever is less). This is in recognition of the fact that the risk of transmission is lower because of reduced mobility around the venue. In addition, proof of vaccination will now be required in outdoor settings where the normal maximum capacity is 20,000 people or more to help keep these venues safe for patrons."

In response to a question in a Townhall earlier today, Deputy Minister of Heritage, Sport, Tourism and Culture Industries, Kevin Finnerty stated that today's announcement does not apply to museums and galleries. 

Minister MacLeod also stated that there are anticipated additional funding announcements to come next week.

"As detailed in the government’s announcement from September 1st, Ontario to Require Proof of Vaccination in Select Settings, museums and galleries are not listed as one of the mandatory settings where patrons must be fully vaccinated to access the facilities.
 
"The settings that will require patrons to be vaccinated were chosen because they are higher risk for COVID-19 transmission due to gatherings and close contact in enclosed, indoor spaces. In addition, in some settings, face coverings are removed to eat or drink or for athletic or fitness activity which increases the risk. In art galleries and museums, there is typically space for individuals to physically distance, individuals tend to move around the facility as opposed to remaining in one place for longer periods of time, and face coverings can be worn at all times, which decreases the risk.
 
"While proof of vaccination for patrons is not required for museums and galleries, it should be noted that indoor meeting and event spaces within museums and galleries will require proof of vaccination for all patrons attending the meeting or event, subject to limited exceptions. However, proof of vaccination for attendees is not required if the space is rented out for:  
  • a day camp or overnight camp for children described in section 19 of Schedule 2 (O. Reg. 364/20 Rules for Areas at Step 3 and at the Roadmap Exit Step);  
  • to a provider of child care within the meaning of the Child Care and Early Years Act, 2014
  • for the purpose of the provision of social services;  
  • for the purpose of delivering or supporting the delivery of court services;  
  • for operations by or on behalf of a government; or  
  • for the purpose of delivering or supporting the delivery of government services

Furthermore, vaccine requirements also apply to indoor performance venues (e.g., concert venues, theatres and cinemas) as well as indoor areas of restaurants, bars, and other food and drink establishments."
